Complying with Health and Safety management system is a matter of every employee. It should be clearly stated in company's HSE policy and rules.
It would be a waste of time and company's resources to keep such employee!
From my personal opinion I believe Construction is a path which every employee needs to use. Whether you have obstacles in the way and challenges, it needs to be dealt with. If you have an employee who is always blocking the road due to negligence and non-compliance, I don't see this employee as a positive investment for the company. In our current times everything you do in construction revolves around safety and has a big influence on time based program schedules. Non-compliance to Safety Procedures could result in major time loss on your project and also give the company a bad reflection as well as jeopardize future tenders. Non compliance to Safety Procedures will also lead to serious injuries which will also have a major effect when tendering for projects. You are representing a company in the field, so put your best foot forward and if the Construction Manager does not want to comply after explaining the consequences of Non-compliance, I will have to deal with the employee according to the Company's Disciplinary Procedure.
In first place, Safety is foremost job for a Construction Manager than the safety officer.
It’s important that he needs to have a good understanding in Company HSE policy, Safety requirements and loss management. Why because he leads the team and the team wants to listen from him. If he doesn’t have the understanding and opposing safety, then its worst place to work, for everyone. So, teach him first!
Let him understand the principles of safety, accident theory etc,
If he understands the concept, infact he implements a better safety than you.
If not, convey the management and arrange a third party training, if ego clash.
If not, let enforce the management to remove the gentle man from work.
If not, better you resigned and do a safer job.
This is not the matter of only one person, this is the matter of culture and behavior. A person will not work for HSE if he will think that HSE is a waste of time, this is the reason why all HSE system focus on tranining and awarensss, at all level. Now the question is how you are going to handle that person, well if he is of your grade for example you both are MAnagers or both are Assistant MAnagers, then it will be difficult for you to handle him unless you take the powers in your hand. However, you can do this by talking to top management who will pressurize him on following the HSE practices.
As they said confrontation is always the best way to resolve any problem/ issue. Talk to the construction manager first and told him about your problem. You must also influence him to change by being a good role model. If these things still doesn't work then that's the time to talk to your higher management like your project manager. It is easy to say this but very difficult to do, but this is work nothing personal.
Product Cost is the main reason that influence people to not adhere safety rules and regulation.You just try to explain him about pro-active cost and re-active cost ,means how product cost vary before the accident and after accident as well as legal law(Consequences after accident) .Try to participate him in site safety visit or meeting.i hope it will help you
Terminate the contractor , he will bring your company into disrepute , hire Me , i will ensure conformity to procedures and Health and Safety
safety first,if a Construction Manager haven't any idea about safety instructions,its normally acting in an improper manner,which is leads to incidents. to correct these behaviors:1- he must doing the best to understand the principles of safety, accidents, hazards,etc,2-giving him traning about safety aim,how to implement safety standards,how to use PPE,how to planning a work to be safe.
In My Opinion, to this kind of man, we should respect him first, try to figure out what his problem. after that, after you have got his opinion and the reason, you should use your best approach skill to explain him about the important of implementing the HSE Procedures. Let him thinking that this procedure could save his life, his team's life and what the impact to his family if he got hurt because ignoring the procedure. as other's said that Safety is not only the Safety Guy's responsibility, its all responsibility beside it need support from all related part to be engaged in the safety role.
Those are the real challenge a Safety Professionals usually encounter on a project. Changing the negative behavior of the CM or any top management personnel is a tough job, but it can easily be persuaded thru internal means (severe diplomatic approaches (if its possible). To inform/ report directly his conduct to his immediate head (the PM), and if its still not effective, then report the concern to external authorities (client or even to police authorities) who can guarantee the legal actions (depending on his performance). Lastly, make it sure that all his unsafe actions be reported as additional points in case formal investigation happens after committing more severe actions. I can be sure that management shall be on the safer side.
Give additional responsibilities to utilize into other aspects of work that can use times wisely and productive.
