Employee and Employer Responsibilities    

Employees (workers) and employers (bosses) both have WHS rights and responsibilities. Find out more about what the law says you and your employer must do to keep the workplace safe.

Employees must:

  1. Work safely to protect themself and others from injury and follow all WHS instructions, for example:
  • wear all personal protective equipment provided.
  • follow safe work procedures.
  • not interfere with or misuse anything provided by the employer (equipment, signs, etc.) that is used to keep the workplace safe.
  • not remove or change machine guards.
  • not behave in a way that puts themselves or others at risk.
  • respond to a reasonable request to provide assistance or first aid to an injured person at work.

..2.  Report any WHS issues, including hazards, injuries, illnesses and near misses.

Employers must:

  1. Properly orientate, train and supervise staff to ensure safe work practices are understood and followed by all employees.
  2. Consult with all employees, including YW, about decisions that will affect safety in the workplace.
  3. Provide suitable personal protective equipment (PPE) to make sure workers can do their job safely and train workers how to use PPE correctly.
  4. Regularly check WHS systems and procedures to make sure that workers are adequately protected from workplace hazards.
  5. Provide adequate facilities for the welfare of employees. This covers everything from providing suitable toilet facilities to conducting risk assessments on premises and procedures.
  6. Be aware of employers’ legal obligations under the NSW Work Health and Safety Act 2011 and the NSW Work Health and Safety Regulation 2011 and meet those obligations in full.

Employers have a general obligation or duty to ensure that the health and safety of every person employed by the employer is protected while they are working. 

  • safe entry to, exit from and occupancy of the work place;
  • first-aid facilities and health services, sanitary and personal facilities, and safe drinking water;
  • employees with the information, instruction, training and supervision necessary to ensure their health and safety at work;

EMPLOYEES

Employees have a responsibility to take all reasonable and necessary precautions to ensure their health and safety and that of anyone else who may be affected by their work or activities. Specifically, the Code requires employees to:

  • use all safety materials, equipment, devices and clothing that are provided by the employer and are intended to protect the employees;
  • follow procedures that relate to the health and safety of employees;
  • follow all instructions provided by the employer concerning the health and safety of employees;

Thanks for the invitation. Employee's responsibility is to work hard to achieve positive results in his career by fulfilling the company's expectations. He can do so by completing his tasks before the deadline and never let someone raise a finger on him. Meaning that he should perform his required duties honestly so there will be no questions raised on his performance by anyone. On the other hand, employer's responsibility is to maintain a learning environment for his employees so that they have their interests developed in the tasks assigned to them. Employer should also keep their employees happy by giving them incentives or giving them bonuses etc. to motivate their employees for more hard work.

As an employer, you have a responsibility to provide and maintain, as far as practicable, a safe working environment for your workers, under  (OSH Act). This is called the employer’s ‘duty of care’.  This includes:

  • providing and maintaining workplaces, plant and systems of work so your workers are not exposed to hazards;
  • providing information about any hazards and risks from the work;
  • providing instruction, training (includin supervision to all employees so are able to work safely;
  • consulting and co-operating with safety and health representatives (if any) and all employees about safety and health; 
  • where it is not  to avoid the presence of hazards, providing adequate personal protective clothing and equipment without any cost to workers; and
  • ensuring safety and health in relation to plant and hazardous substances so workers are not exposed to hazards.

You must also ensure that the safety and health of people who are not your workers  (ie non-employees) is not affected by the work, a hazard or the system of work. This duty, under section 21 of the OSH Act, applies where there are visitors, volunteers, work experience students or any other people at the workplace.

As an employer, you also have a responsibility to inform all your employees about:

  • how to resolve any complaints or concerns about safety and health at work;
  • what to do in an emergency;
  • what to do if they are injured; and
  • their rights to workers’ compensation if they are injured.

Under the OSH Act, as an employer must: 

  • when a safety and health issue arises where there are different opinions, attempt to resolve it according to the relevant (issue resolution) procedure (Section 24 of the OSH Act); 
  • report certain types of injuries and diseases and deaths arising in connection with work to WorkSafe (Section  23I of the OSH Act); 
  • in the Occupational Safety and Health Act 1984. You may also set these up on your own initiative.

Where you receive a report from an employee about hazards or any injury or harm to health, you  must within reasonable time after receiving the report: 

  • investigate the matter and determine the action, if any, to be taken; and 
  • notify the employee about what was decided

Employer should pay salary on-time and don't assign more work on the employee and followup the work

Broadly speaking, employer is responsible for having a clear cut mission & vision to work for the betterment of society and enhancing the economy of the country. Keeping this in mind, an employer has to develop his or her Business Value. 

Whereas an employee is responsible for aligning himself or herself to achieve the the employer's (organization's) strategies and goals.

A lot is already said about this. Infect responsibilities are decided when you are going to sign an contract with an employer to lend your services against some predecided terms and conditions. Further to this add the local labor laws which varies nation to nation, country to country. So I say its mutual understanding. Not a standard.
