The question in terms of "responsibility" is a very broad and open question. Each person on that particular work site will be "responsible" for any incident that may occur on a site. For years the fundamental principle of H&S in the work place has been that each person is responsibe for his own as well as his "brother/sisters" safety.

 

If we look at the question in terms of "Accountable/accountability" then we are more inclined to focus on the point of "Liable Accountability" for an incident on a site.

 

In most parts of the world where a top level of H&S is practiced, the blame culture is long gone, the objective now is not who is responsible, but more who is liable and can be held accountable for his or her actions which resulted in the incident happening in the first place.

 

This could range from the CEO of a company, to the actual person and persons involved in the incident. This is why i cannot stress enough that every company that has an involvement with the community or where people are employed should have a top notch H&S Department who report directly to the shareholders or CEO of the company.

 

This is not a simple procedure either, Incident investigations, interviews, scene analysis, procedural reviews and many other aspects must be investigated to establish the root cause of the incident.

 

Only then and only if the investigation reveals beyond a reasonable doubt the root caue of the incident may "Accountability" be made.

 

So, once again, bear this in mind, the objective is not to allot blame, but most importantly, it is to seek a reason for why and how the incident could be prevented for the future.

 

In the end, we are all human, we do make mistakes, and people are going to get hurt at work, we need to take the proactive and mature approach of how do we prevent these things from happening and if they do, how do we stop them from happening again.

I think the contarctor is responsible for accidents that occured on the work site either to the workers or to the third party.  In insurance, contractor can cover such riks by a contarctors all risk insurance policy for third party accidents and a workmen compenstation insurance policy for the workers.
