Like all applications uses a port number, BGP also uses well known port number (TCP port). It rides over our existing TCP/IP structure, Hence BGP is a Application layer Protocol. 

Also BGP is an application layer protocols cause it is dependent on TCP and UDP, which encapsulates BGP and RIP segments respectively.
