an awarded patent is one way to tell. All products borrow from previous experience in some extent and the plethora of patent issues and claims are a demonstration of how difficult it is to determine the novelty in one given product.

Market is the real judge.

I couldn't really understand the question but may be i think of something similar. I think a product can be described as truly new if its the first time its produced, made aware & offered for sale to customers or public, it excludes products that have been reviewed or put back to refurblishing.
