Fidic  as any other  Conditions of contract, imposed to provide rules, guidelines and a mechanism for dispute resolution.

Communication starts with the tender and continues throughout the contract. It’s a two way thing and Client and contractor alike must work hard at maintaining a relationship by sharing information and No surprises.

I worked many years with all form of FIDIC contracts. My advice is to use those form as a base for negotiation between commercial contracting parties, but in case of public works you must follow the conditions and terms of contract which comply with public local law, rules and by-laws. Also, when negotiating the conditions and term of contract you must adjust them to comply with governing law of the contract. Some of the FIDIC principles and contractual mechanism are on a collision course with governing law principles and terms.

Unfortunatelly no. Maybe I'm wrong but corporations like FIDIC are very valuabel since they provide the conceptual architecture that helps building the management framework in certain aspects of the business.
