Why consortium is not allowed to participate in civil tender?

Dear Sir

 

Could you please enlighten as to why consortium is not allowed to participate in tendering. In most of Invitation of tenders one can do find such clauses.

Consortium does not have a individual legal entity as required by Government contracts hence in many government tenders it is prohibited. In joint ventres and companies the companies are treated as single entity whereas in consortium the ompanies retain their individual entity.

Dear Sir

Your statement that Consortia arent allowed to participate in tendering is not accurate. Consortia like Joint Ventures, do participate in tenders providing they meet the requriements of the governing laws in their country of operation.

Example is a company cannot tender both as an individual and as a consortiium for the same bid. However, many laws in some countries prohibit or restrict consortia participation to allow competitive tendering.
