A "trademark" is a word, name or symbol which is used to identify particular products or services offer by a particular manufacturer or from a particular source.The trademark distinguishes and authenticates a product of a particular manufacturer from similar products offered by others. The owner of a Trademark has the right to prevent others from using the same or similar trademark on their products.A mark is not eligible to be registered if it is immoral, deceptive or scandalous matter,

My answer is Yes definitely. My answer is based on logical reasoning. Trademark should be unique for every company. It's a symbol or a logo needed by a company to be identified immediately. How can you defend your trademark if it has been used by another company if it's not registered?

What is a Trademark?  

A Trademark generally refers to a “brand” or “logo”.

Trademark registration can also be obtained for a business name, distinctive catch phrases, taglines or captions.

Properly used and promoted, a Trademark may become the most valuable asset of a business. Trademarks such as Coca Cola, HP, Canon, Nike and Adidas serve as an indication of origin of the goods as well as an indication of quality. 

It is also essential to obtain trademark registration for the business name/trade name under the Trademarks Act. Registration of a company or business name under the Companies Act does not in itself give protection against others who might commence using identical or similar marks.

Use of TM, SM and ® symbols

'TM' stands for Trademark and 'SM' stands for Servicemark. The use of TM and SM symbols notifies the public that the company is claiming exclusive ownership of the trademark and can generally be used by one who has filed a trademark application.

The ® symbol, can be used only once the trademark is registered and the registration certificate is issued. Also, you may use the registration symbol only in connection with the goods and/or services in respect of which the trademark is registered. The registration process is the same for both trademarks and servicemarks.

Highly recommended to register asap ,Trade mark works as brand name or logo which is actual image presentation of company. Some time original firm name used as logo or graphical symbols.

It helps in better image perception and a great promotional tool.

Even though there are lot of small companies who have their trade mark which are not registered, it is advisable to register the trademark so that others cannot use it and the trade mark solely belongs to the person or company who has registered it.
