Industrial Action is more a business term used for Project Management. It's an objective of a work which means a task has to be completed within a time frame considering project planning,administration, scheduling, safety, timeline, scope and cost.

If workplace disputes are not resolved, it can lead to industrial action.

Industrial action usually happens when a dispute in the workplace can't be resolved through negotiation. There are three main forms of industrial action:

  • strike - where workers refuse to work for the employer
  • action short of a strike - where workers take action such as working to rule, go slows, overtime bans or callout bans
  • lock-out - a work stoppage where the employer stops workers from working

Industrial action is 'official' if it is formally backed by a trade union and members of that union are taking part in it. If you're involved in industrial action against your employer, you'll probably be in breach of your employment contract and you are therefore unlikely to be paid when taking industrial action.

 

However, you will be protected against being dismissed for taking industrial action provided your union follows the right procedure when organising

Industrial action can take a number of forms and is defined in the Fair Work Act2009

(Cth) (FW Act). It can include strikes, stoppages of work, work bans, lock-outs and

the performance of work by an employee in a manner different from that in which it is

customarily performed.

Industrial action is generally unlawful and prohibited unless it is protected industrial

action. Employees who engage in industrial action which is not protected under the

FW Act can be exposed to penalties and disciplinary action.
