Employees who have been slapped with a six-month labour ban for breaking their contracts before the expiry of two years can work for a new company, provided they hold at least a high school diploma and have been offered a good position and salary by the new company, employers were told by the Ministry of Labour .
To lift the6 month labour ban, an employee should have been offered a minimum salary of
-AED5, for high school graduates,
-AED7, for diploma holders and
-AED, for bachelor’s degree holders. (This salary must be mentioned in the labour contract.)
-Obtain No Objection Certificate from current employer.
Another way you could avoid labour ban is:
-You obtain a job in a Government, Semi-Government or in Free Zone based Companies.
No fee will be imposed for lifting the labour ban when these conditions are met, Ali Al Shehi, Senior Administrator at the ministry, said in a seminar held to inform employers about their rights and duties as well as recent ministerial decisions.
“We are still imposing the six-month labour ban on employees who quit their jobs before completing two years of service, but the ban can be lifted if the new employer offers the candidate a good position and an appropriate salary,” he said.
The new employer needs to submit the employee’s educational qualification certificates, which does not need to be attested at this stage. It will be scanned and entered into the Tas’heel system, and a new labour permit will be issued accordingly.
employers that as of January, company categories will have a different scale when it comes to labour permit applications.
“When a new company is registered, it will be charged AED1, for each of the first four work permits to be issued to the company, which corresponds with category B2,” he said.
Afterwards, the company can move up or down categories B1, B2 or B3, or C depending on its activity, the number of employees it hires, their qualifications and diversification in the nationalities of workers.
Companies in B1 category pay AED per work permit, while B2 companies pay AED1, and B3 companies pay AED2, for each permit.
Now labor law alrady change ban case.
you are make it certificate professions(eg:- Sales Executive, Managers, Engineers.....etc) not under your employment visa not comming any ban. you can do the cancellation at any time. but you are apply with out certificate profession (eg:- Sales, Archives cleark, labour works...etc) you are cancelled befor 6 months. you will get one year labour auto ban. This is only for Unlimited contract case
Your contract company make it limited you try to make cancellation befor the contract peroied. previous company requsting you will get a ban.
A 6 month labour ban is an automatic ban which is imposed when you leave your current job without any proper reason. Every employee under Ministry of Labour is automatically banned for 6 month; unless they are exempt from ban due to their new employer status (Freezone, Government), qualification above High School Diploma and salary of AED 50010 for High School, AED 7000 for Diploma holders and AED 12000 for Bachelor’s degree holders.
to stay in the safe side complete your probation period wich maybe could be 1 , 3 or six months as witten in your labour contract but if that happen and you are not able to complete or terminated before this period you have to apply for next position in your new contract high profession not mid level but profession with high livel of education which requires attested certificate and salary more than 5000 aed
