Mediation is to be a third part to resolve a dispute between 2 or more Parties
so Negotiation is a tool used in Mediation and not the vice versa
Mediation may be direct or indirect, Depends on the parties on the table, to negotiate with each party individually is indirect mediation
Mediation preparation is slightly different than negotiation planning where you should study the root of dispute and psychological roots and the relations between you and the others
Mediation is the help of a “neutral” third party in a dispute between two parties in order to facilitate their cooperation towards reaching a settlement or a fair resolution of their dispute to reconcile interests.
It starts to be a tool but with time & experience, the mediator develops the “Skill” because it requires a lot of patience, good listening & communication, responsibility, excellence in persuading, showing respect always to all parties, keep the focus on interests of all parties by putting his feelings aside and being unbiased and work on the best solution for all interests.
Mediation is a way to find a middle way through third party to solve the issue . Its basically a part of negotiations and it will also help to improve trust on each others but we cant use it everytime
So basically, Mediation is a third party involved in resolving two parties of an agreement like; for instance. an employer (first party) on a freelance (mediator) website is demanding a certain service and is connected to a freelancer (second party), the service is agreed to be delivered in one week , after one week the service has been delivered but with bad quality so, the First Party requests for a refund as of the bad quality but the Second Party refuses and the money is still on hold at the freelance website (Mediator).
The First Party opens a dispute against the Second Party for the amount to be refunded and bad quality service to be shown, both parties start providing their evidences to the Mediator as to guarantee that both parties are receiving their rights Fairly according to the evidence provided.
As for the Mediator, should require High Analytical skills in order to analyze each situation carefully, Negotiation skills so that both parties can reach to a satisfactory solution, Can handle crisis through rational and critical thinking.
Simply put the role of a mediator in dispute resolution is to act like a referee, giving directions to parties in relation to the mediation process, managing the conduct and development of the negotiations as well as bring unweldly parties to heal. In doing this his skill is knowing when and what to say in order to encourage communications, negotiations and settlement of a dispute. It is important that he is independent, impartial and avoids expressing personal views on the issue. Mediation is generally the first formal step in Alternate Dispute Resolution before more fomal arbitration or litigation processes.
