Scenario: - An Employee under (Limited Contract), after completing 5 years in one company renewed his visa and after 2- 3 months he resigned.

1) Whether the company can hold his45 days salary.2) Can company hold his Gratituty .

I would say1) No and2) No, but then that depends on the reason and wording of their employment contract, notice given and so on.

Personally, if the employee has given me5 good years,45 days salary they have earned and my best wishes would go with them.

I may think about cancelling their visa though depending on visa restrictions and if I am liable for their visa.
